Welcome to Ross Townsend Gallery. By accessing this website or purchasing artwork through www.rosstownsendgallery.com, you agree to the following Terms and Conditions.

1. Artwork and Product Information

Ross Townsend Gallery offers original artworks created by Australian artist Ross Townsend.

Every effort is made to accurately represent each artwork through photographs, descriptions, dimensions and pricing. However, colours may vary slightly depending on individual screen settings and lighting conditions.

As each painting is an original work, natural variations in texture, brushwork and finish are part of its unique character.

All artwork is subject to availability. As original paintings are generally one-of-a-kind, once an artwork has been sold, it may no longer be available for purchase.

2. Pricing and Payments

All prices displayed on this website are in Australian Dollars (AUD).

Payment is required in full before artwork is dispatched, unless otherwise agreed in writing.

Payments are processed through the secure payment options available at checkout.

Shipping costs, where applicable, will be displayed at checkout or confirmed before purchase.

Any applicable taxes will be included or identified as required by Australian law.

Ross Townsend Gallery reserves the right to correct pricing errors and update prices without notice. If a pricing error affects an order already placed, we will contact you to discuss the available options, including a refund where appropriate.

3. Shipping and Delivery

Ross Townsend Gallery takes care to ensure artwork is securely packaged for transportation.

Delivery costs and available shipping options will be provided at checkout or arranged directly with the purchaser.

Estimated delivery timeframes may vary depending on the artwork's size, destination and delivery provider.

Customers are responsible for providing accurate delivery information.

If artwork arrives damaged, please contact Ross Townsend Gallery as soon as possible, preferably with photographs of the packaging and artwork, so the issue can be assessed and resolved.

Nothing in these terms limits your rights under Australian Consumer Law, including your rights where goods are damaged during delivery.

4. Returns and Refunds

We encourage customers to carefully review artwork descriptions, photographs and dimensions before purchasing.

As original artworks are unique, Ross Townsend Gallery does not generally offer returns or refunds for change of mind.

However, customers are entitled to remedies under Australian Consumer Law where applicable, including where artwork is faulty, damaged, significantly different from its description or otherwise fails to meet applicable consumer guarantees.

If you experience an issue with your purchase, please contact us so we can work towards an appropriate resolution.

5. Copyright and Intellectual Property

All original artworks, photographs and written content displayed on this website are protected by copyright unless otherwise stated.

Copyright in artworks remains with Ross Townsend unless expressly transferred through a written agreement.

Purchasing an original artwork transfers ownership of the physical artwork but does not transfer copyright or reproduction rights.

Images of artworks must not be reproduced, distributed, commercially used or sold without prior written permission, except where permitted by law.

6. Commissions and Special Orders

Commissioned artworks may be available by arrangement.

Details including subject matter, dimensions, pricing, payment arrangements and estimated completion timeframes will be agreed upon before work begins.

Any additional terms relating to commissions, including deposits, revisions and cancellations, will be communicated and agreed upon separately.

Nothing in these arrangements excludes rights provided under Australian Consumer Law.

7. Website Use

Visitors agree to use this website lawfully and respectfully.

Website content is provided for general information and may be updated without notice.

While reasonable care is taken to maintain accurate information and website availability, occasional errors or technical interruptions may occur.
